As dimensões laborais da Carta Africana dos Direitos Humanos e dos Povos

O presente artigo parte da premissa de que a Carta Africana dos Direitos Humanos e dos Povos constitui um pilar normativo essencial para a construção de um direito do trabalho emancipatório em África. Para além da leitura fragmentária do artigo 15º, o estudo revela o potencial transformador da Carta, defendendo que a sua natureza sui generis oferece um paradigma alternativo ao modelo liberal-individualista dominante. A investigação qualitativa e dogmática mostra como este arcabouço filosófico sustenta uma rede de proteção laboral, desde condições de trabalho equitativas até um modelo de desenvolvimento econômico centrado no trabalho digno como direito coletivo. Examina ainda a sinergia entre a Carta e o sistema normativo da OIT, destacando o princípio da norma mais favorável e a eficácia diagonal como vetores de proteção intensificada. Sem ignorar os desafios de efetividade, analisa a jurisprudência dos órgãos africanos e os obstáculos políticos à implementação. Conclui-se que a plena realização deste potencial exige litigância estratégica, diálogo judicial corajoso e apropriação da Carta pelos atores sociais.
