The stigma of obsesity and overweight in Labor Law

The study examines the impacts of obesity and overweight stigmatization within Labor Law, identifying legal instruments applicable to combating fatphobia and proposing normative developments. The literature review shows that obesity, far from being only a health condition, generates social stigma with negative effects on labor relations. Despite constitutional and statutory protections against discrimination, fatphobia still lacks specific legal recognition. In this context, the application of Precedent No. 443 of the Superior Labor Court (TST) is defended as a means of protecting workers with obesity from discriminatory dismissals, aiming to foster social inclusion and safeguard fundamental rights.
