Artificial intelligence is being used extensively by companies to make automated decisions about selection, hiring, task distribution, salary definition, work hours, career progression, sanctions and dismissals of workers. The impacts, risks and challenges of using AI to manage human labor are significant. This essay analyzes the legal response to the phenomenon and the process of formation of “Algorithmic Labor Law”, formed from the establishment of principles and rules to regulate the management of human labor through artificial intelligence. It then examines the main legal instruments implemented and under formation in the European Union and Brazil.
