Stalking and cyberstalking in the workplace
the possibility of moral harassment

The research problem is to question the relationship between the practice of stalking and cyberstalking in the workplace and the possibility of moral harassment under Brazilian law. The main objective of this paper is therefore to demonstrate the relationship between the practice of stalking and/or cyberstalking and the configuration of moral harassment in the workplace, which is not necessarily confused with it. It is based on theoretical research with a qualitative approach, a bibliographic documentary survey procedure and a predominance of deductive logic, and then an empirical analysis in the Brazilian labor courts, especially the TST, with a quantitative-qualitative approach and inductive logic. The conclusion is that there is a distinction between conduct in relation to bullying, which facilitates it.
