Abstract

This paper seeks to offer a critique regarding the Supreme Court’s decision in Extraordinary Appeal n. 1,121,633, which culminated in the establishment of TRG n. 1,046, which admitted the reduction of the intra-workday break through collective bargaining, despite the fact that it is an occupational health and safety rule. Initially, the paper deals with health and safety at work as fundamental rights of workers. Next, it deals with the theory of the prevalence of what was negotiated over what was legislated, included in the Consolidation of Labor Laws by Federal Law No. 13,467/2017. Finally, the paper deals with the unconstitutionality of article 611-A, item III, of the Consolidation of Labor Laws, for being an affront to article 7th, item XXII, of the Federal Constitution and for clearly being a regression of social rights.
