This paper discusses the constitutional jurisdiction of the Labor Courts and the recent decisions on Constitutional Claims by the Supreme Court, highlighting the shift in the Supreme Court’s jurisprudence on the subject. A reductionist interpretation has prevailed, contrary to the trend of expanding the normative scope of the Labor Court’s material competence in constitutions. This jurisprudential orientation, which began with Constitutional Amendment 45/2004, has intensifed since 2020. The recently adopted understanding contradicts the notion of truth inherent to the Constitutional State, which should rely on a necessary analysis of constitutional facts to establish the scope and meaning of the term “employment relationship” and to defne the parameters of the specialized Labor Court’s jurisdiction.
