Abstract

This paper examines workers’ right to health in the workplace, focusing on government employee, whether statutory or contractual, highlighting the protection guaranteed by the Federal Constitution and related rules. It analyzes the legislative competence of the Federal Government and the interaction with regulatory norms to ensure safe working conditions. It also discusses jurisdictional competence on the subject, considering the hybridity of work environments and the different employment relationships. The case law of the Supreme Court and the Superior Labor Court is explored, emphasizing the role of labor and administrative rules in collective and individual protection. The conclusion advocates for harmonized application of rules, preserving the dignity of workers in any work context.
